SB 1002 Summary

• Expands firearm and ammunition prohibitions for individuals deemed a danger to themselves or others due to mental health conditions, not guilty by reason of insanity, mentally incompetent to stand trial, or under conservatorship for grave disability.

• Requires persons subject to mental health-based firearm prohibitions to relinquish firearms, deadly weapons, and ammunition within 72 hours of discharge from a facility or within 14 days of a court order, with receipt required as proof.

• Authorizes search warrants to seize ammunition owned by or in the custody of individuals subject to firearm prohibitions under Welfare and Institutions Code Section 8103, with additional grounds for seizure based on Code of Civil Procedure Section 527.9 restraining orders.
