SB 1012 Summary

• Establishes the Board of Regulated Psychedelic Facilitators within the Department of Consumer Affairs to license and regulate psychedelic facilitators, with board appointment by April 1, 2025, and license applications beginning April 1, 2026.

• Creates the Division of Regulated Psychedelic-Assisted Therapy within the Business, Consumer Services, and Housing Agency to regulate production, distribution, testing, and sale of regulated psychedelic substances (psilocybin, psilocyn, MDMA, DMT, mescaline, and related spores/mycelium) for use only in conjunction with licensed facilitation at approved locations.

• Establishes a Regulated Psychedelic Substances Expert Oversight Committee to advise on standards, regulations, and best practices, requiring annual public reports on implementation and outcomes starting January 1, 2026.

• Allows local governments to reasonably regulate time, place, and manner of psychedelic facilitation but prohibits complete bans on licensed operators or services; restricts use to adults 21 and older at approved locations with licensed facilitators.

• Creates two revenue funds: the Regulated Psychedelic Facilitators Fund and the Psychedelic Substances Public Education and Harm Reduction Fund, with licensing fees supporting regulatory operations and education/harm reduction grants.
