CA SB1209

Authorizes local agency formation commissions (LAFCOs) to require applicants to agree to defend, indemnify, and hold harmless the LAFCO and its agents, officers, and employees from claims, actions, or proceedings that attack, set aside, void, or annul LAFCO approvals.

Requires LAFCOs to promptly notify applicants of any claims or proceedings and to cooperate fully in the defense; applicants are not responsible if the LAFCO fails to notify or fully cooperate.

Prohibits applicants from being required to pay or perform any settlement without their approval.

Allows LAFCOs to participate in their own defense if the LAFCO bears its own attorney's fees and costs and defends the claim in good faith.

Applies to changes of organization, reorganization, sphere amendments, sphere updates, and other actions or determinations requested from the LAFCO.
