CA SB1275

Amends Penal Code Section 647 to allow prosecution for soliciting someone to commit prostitution when the offender believes the person is a minor, even if the person is actually 18 years of age or older.

Establishes that violation of the new solicitation provision is punishable by imprisonment in county jail for not less than two days and not more than one year, or by a fine not exceeding $10,000, or both.

Allows courts to reduce or eliminate the mandatory two-day minimum jail sentence in unusual cases where the interests of justice are best served, with reasons to be specified on the record.

Provides that no state reimbursement is required because the bill only creates new crimes or changes penalties within existing authority under the California Constitution.
