SB 1380 Summary

• Eliminates "under state receivership" as a standalone basis for school districts to deny charter school petitions based on fiscal impact concerns.

• Replaces receivership standard with specific conditions including: districts with outstanding emergency apportionment loans, districts within the trustee reassumption period with qualified/negative interim certification, and districts with positive/qualified interim certification that closed schools within 5 years and would receive qualified/negative certification if charter approved.

• Requires county superintendent of schools to certify fiscal impact findings in consultation with the County Office Fiscal Crisis and Management Assistance Team when determining if charter approval would result in qualified or negative interim certification.

• Removes provisions prohibiting submission of substantially similar countywide charter petitions to county boards of education after school district denial.

• Establishes that state must reimburse local agencies and school districts for any costs mandated by this bill as determined by the Commission on State Mandates.
