SB 1414 Summary

• Applies solicitation of a minor offense only to defendants 18 years of age or older at the time of the offense.

• Makes solicitation of minors under 16 years old, or minors under 18 who are human trafficking victims, a wobbler offense punishable by up to 1 year in county jail and/or up to $10,000 fine, or by imprisonment pursuant to Section 1170(h).

• Requires mandatory 2-year felony imprisonment for second or subsequent violations of the above provisions involving minors under 16 or human trafficking victims under 18.

• Requires sex offender registration for 10 years for adults 18+ convicted on or after January 1, 2025, of soliciting a minor if the defendant was more than 10 years older than the minor at the time of offense.

• Incorporates conditional amendments to Section 647 based on concurrent enactment of SB 926, AB 1874, and AB 1962, with provisions determining which version becomes operative depending on which bills pass and their enactment order.
