SB 168 Summary

• Commences automatic conviction record relief on July 1, 2024 for persons convicted on or after January 1, 2005 of felonies who completed all incarceration and supervision terms and remained conviction-free for 4 years, with confirmation provided via state summary criminal history record.

• Requires courts to electronically transmit death penalty judgments and warrants to the Governor in mutually agreed format, eliminating the requirement to provide complete trial transcripts.

• Removes requirement that petitioners for certificate of rehabilitation and pardon notify the Governor's office, keeping only district attorney notification.

• Updates Penal Code references to remove obsolete closed prison facilities and clarify Department of Corrections and Rehabilitation jurisdiction over currently operating state prisons.

• Appropriates $116,144,900 from General Fund to State Community Corrections Performance Incentives Fund for fiscal year 2024-25, representing a 5.5 percent reduction from previous years with minimum $200,000 per county floor.
