Adds Section 11352.3 to the Health and Safety Code to impose an additional punishment of 3, 4, or 5 years for convictions involving fentanyl or fentanyl analogs designed, shaped, colored, advertised, or packaged to resemble food or candy.

Applies the enhanced penalty to violations of Section 11351 (possession for sale) and Section 11352 (transportation, sale, or trafficking) involving fentanyl made to look like food or candy.

Defines "food" as any article used for food or drink and "candy" as sugar or sweetener-based preparations with chocolate, fruits, nuts, or other ingredients in bars, drops, or pieces.

Addresses the rising threat of "rainbow fentanyl," which has increased fentanyl-related deaths by 365 percent between 2019 and 2021 and youth deaths (ages 10-19) by 625 percent from 2018 to 2020.

Includes a provision stating no state reimbursement is required for local agencies or school districts because the enhanced penalties constitute a change in criminal penalties under Section 17556 of the Government Code.
