CA SB44

Requires courts to advise persons convicted of or pleading guilty/no contest to selling, transporting, importing, or administering controlled substances containing fentanyl or fentanyl analogs that these substances are deadly and that death resulting from selling or administering them can result in homicide charges, including murder.

Court must read the advisory statement in cases where a person exchanged a controlled substance containing fentanyl or its analogs for anything of value, except when exchanged for another controlled substance or alcohol.

Advisory statement must be included in plea forms or specified on the record, and the fact that the advisory was given must be recorded in the abstract of conviction.

Prohibits the advisement from being used as evidence in the prosecution of a minor in juvenile court.
