CA SB442

Creates new misdemeanor crime of causing another person to masturbate or touch an intimate part of themselves or a third person for purposes of sexual arousal, sexual gratification, or sexual abuse, punishable by up to 6 months in county jail and/or fine up to $2,000

Increases penalty to up to $3,000 fine and/or 6 months jail if the defendant was an employer and victim was an employee

Requires fines above $2,000 collected from employer-defendants to be transmitted to the State Treasury and distributed to the Civil Rights Department for enforcement of fair employment and housing laws

Expands existing sexual battery statute (Section 243.4) to include causing someone to masturbate or touch an intimate part, in addition to direct touching offenses

Applies to scenarios where victim is unlawfully restrained or institutionalized for medical treatment and seriously disabled or medically incapacitated
