SB 508 Summary

• Adds Section 26051.6 to the Business and Professions Code to clarify the Department of Cannabis Control's responsibilities under the California Environmental Quality Act (CEQA)

• Exempts the Department of Cannabis Control from serving as a responsible agency under CEQA if the local jurisdiction acting as lead agency has filed a notice of determination or exemption with the Office of Planning and Research

• Requires the local jurisdiction to have completed CEQA review through either a mitigated negative declaration, environmental impact report, or retail exemption for the commercial cannabis activity

• Establishes that the exemption applies only when the cannabis project for which the applicant seeks a state license is the same project analyzed by the local jurisdiction under CEQA
