CA SB58

Decriminalizes possession, preparation, and transportation of psilocybin, psilocyn, dimethyltryptamine (DMT), and mescaline in specified quantities for personal use by persons 21 years or older, effective January 1, 2025.

Establishes allowable amounts: 1 gram of DMT, 1 gram of psilocybin (or 1 ounce of mushrooms containing it), 1 gram of psilocyn (or 1 ounce of mushrooms containing it), and 4 grams of mescaline per person.

Exempts paraphernalia related to these substances from drug paraphernalia prohibitions and allows possession of items for testing and analyzing controlled substances.

Requires the California Health and Human Services Agency to convene a workgroup by January 1, 2025 to study and recommend a framework for therapeutic use of these substances, including facilitated or supported use in community-based settings.

Maintains criminal penalties for possession on school grounds, possession by minors, and distribution to persons under 21 years of age, with enhanced penalties for transfers to minors under 14 years old.
