CA SB700

Prohibits employers from requesting information from job applicants about their prior use of cannabis, effective January 1, 2024.

Exempts information about prior cannabis use obtained from a person's criminal history if the employer is permitted to inquire about it under California Fair Employment and Housing Act Section 12952 or other state or federal law.

Does not permit employees to possess, use, or be impaired by cannabis on the job or affect employer rights to maintain drug-free workplaces under Health and Safety Code Section 11362.45.

Does not apply to positions requiring federal government background investigations or security clearances, or to positions subject to federal testing requirements as a condition of employment or federal funding.

Does not apply to employees in the building and construction trades.
