CA SB796

Creates a new crime of threatening to commit violence resulting in death or great bodily injury to anyone on the grounds of a school or place of worship, including through electronic acts.

Requires the threat to be unequivocal, unconditional, immediate, and specific, and must cause a person to reasonably be in sustained fear for their own safety or another person's safety.

Punishable by imprisonment in county jail for up to one year or state prison; however, persons under 18 years of age are guilty only of a misdemeanor.

Defines "school" to include preschools, elementary through high schools, community colleges, universities, and locations of school-sponsored events, and "place of worship" as churches, synagogues, temples, mosques, and similar buildings.

Does not require state reimbursement to local agencies or school districts under the California Constitution because it creates a new crime with associated penalties.
