Authorizes the Department of Justice to submit fingerprints to the FBI for retention and searches against future fingerprint submissions, including latent fingerprint searches.

Permits the Department of Justice to collect fees from eligible agencies for federal subsequent notification services and remit those fees to the FBI.

Establishes procedures for background check requests, including requirements that the Department of Justice conduct research to obtain complete disposition data and that employers maintain signed waivers from applicants authorizing release of criminal history information.

Requires employers and human resource agencies to notify applicants in writing of their right to obtain a copy of background screening reports, challenge the accuracy of information, and obtain a determination on the validity of challenges before final employment decisions are made.

Provides immunity from liability to the state, political subdivisions, and their agencies for providing criminal history information or fitness determinations made by employers under this section.
