Grants the BART Inspector General full authority to maintain an independent audit and investigation program with access to all district records, files, documents, and property of external entities performing work for BART.

Requires the office to notify employees represented by employee organizations of their right to representation before conducting investigatory interviews and to obtain written waivers if employees elect to proceed without representation.

Authorizes the BART Inspector General to issue subpoenas for witnesses, subjects, and production of records in investigations or audits relating to improper activities by non-employees, after first seeking voluntary cooperation.

Establishes that all office records are public documents subject to the California Public Records Act, except for incomplete audits, personal correspondence upon request, employee survey information that could identify individuals, and investigative files subject to confidentiality protections.

Makes legislative findings to justify limitations on public access to certain investigatory records and work product as permitted under the California Constitution.
