• Expands "public works" definition effective January 1, 2026 to include offsite custom fabrication of sheet metal HVAC ducts for public works projects, requiring prevailing wage compliance and written time records certified by employees.

• Requires contractors engaging offsite fabrication facilities to enter written contracts ensuring compliance with prevailing wage laws; out-of-state facilities exempt from contractor registration requirements if the hiring contractor is registered.

• Changes prevailing wage calculation from wages "in the locality in which the work is performed" to "in the locality in which the public work project is located" effective January 1, 2026.

• Makes contractors and subcontractors jointly and severally liable for prevailing wage violations at offsite out-of-state fabrication facilities; allows contractors to seek indemnity from fabrication facilities for unpaid wages or penalties.

• Expands willful violations of prevailing wage laws to be misdemeanors and imposes state-mandated local program costs for enforcement of these new requirements.
