Department of Technology must develop and adopt regulations by January 1, 2027 establishing procurement standards for automated decision systems (ADS) used by state agencies.

ADS procurement standards must include detailed risk assessments, equity assessments analyzing impacts on communities and individuals, adverse incident monitoring procedures, data minimization requirements, and identification of prohibited use cases.

Department must consider principles from specified publications including the White House AI Bill of Rights, NIST AI Risk Management Framework, and other federal AI governance standards when developing regulations.

Starting January 1, 2027, state agencies are prohibited from procuring or contracting for ADS or services using ADS until the Department adopts regulations, and all ADS contracts must include risk assessments, monitoring procedures, and notice/appeal rights for affected individuals.

Department must collaborate with government employees, civil rights experts, community organizations, and the California Privacy Protection Agency in developing standards, and review and update standards annually beginning January 1, 2026.
