CA SB901

Establishes eligibility restrictions for commission or enlistment in the California National Guard and State Guard for persons who actively participate in advocating for or engaging in unlawful force, violence, or illegal means to deprive individuals of constitutional or legal rights.

Prohibits eligibility for persons who advocate for or engage in unlawful force to achieve political, religious, discriminatory, or ideological goals, or who advocate for terrorism, overthrow of government, or treason.

Requires officers commissioned in the California National Guard to receive an other than honorable discharge if they actively participate in prohibited conduct, and enlisted personnel to receive an other than honorable discharge under the same circumstances.

Mandates discharge of State Guard members under undesirable conditions if they actively participate in any of the prohibited conduct listed in the bill.

Defines "active participation" by reference to Department of Defense Instruction 1325.06 or any successor regulation.
