Social media platforms generating over $100 million in annual gross revenue would be liable for statutory damages if they fail to exercise ordinary care and cause injury to a child (under 18 years old)

Damages would be the greater of either $5,000 per violation (capped at $1 million per child) or three times the child's actual damages

Any waiver of these liability provisions would be void and unenforceable as contrary to public policy

The law applies only prospectively and does not cover legal cases pending on or before January 1, 2026

The bill's findings state that major social media platforms knowingly deploy features that injure children, including contributing to child deaths, while costs are borne by parents, schools, and taxpayers
