Prohibits health care service plans and insurers from using discriminatory factors or biased evidentiary standards when designing nonquantitative treatment limitations (NQTLs) for mental health or substance use disorder benefits

Requires plans and insurers to collect and evaluate data assessing the impact of NQTLs on access to mental health and substance use disorder benefits compared to medical/surgical benefits

Mandates detailed comparative analyses of each NQTL applicable to mental health or substance use disorder benefits, documenting design factors, application methods, and outcomes data

Requires submission of comparative analyses to the Department of Managed Health Care or Department of Insurance by January 1, 2027, and annually thereafter

Authorizes departments to direct plans or insurers to stop imposing an NQTL found in violation of parity requirements and requires notification to all enrollees within seven business days of a final noncompliance determination
