Prohibits public employers from questioning public employees, union representatives, or exclusive representatives about confidential communications made between employees and their union representatives regarding matters within the scope of representation

Bars public employers from compelling employees or union representatives to disclose confidential employee-representative communications to third parties

Exempts criminal investigations from these protections and does not supersede Government Code Section 3303 (which governs public safety officer investigations)

Codifies the protections as consistent with the Public Employment Relations Board decision in William S. Hart Union High School District (2018) PERB Dec. No. 2595

Applies broadly to public employers covered under existing labor relations laws including the Meyers-Milias-Brown Act, Ralph C. Dills Act, and provisions relating to public schools and higher education
