Providers must demonstrate substantial fiscal impact from repayment and prove the overpayment resulted from a policy change or departmental error not caused by the billing provider

Preserves the department's right to reinstate interest and pursue all legal remedies, including payment offsets, if a provider defaults on a repayment agreement or files for bankruptcy

Authorizes the department to implement these provisions through information notices, all-county letters, or similar instructions without formal regulatory action

Limits judicial review of the department's discretionary decisions to writ of mandate proceedings for abuse of discretion
