Real estate brokers, salespersons, or their agents must disclose when advertisements or promotional materials for property sales include digitally altered images, with a conspicuous statement adjacent to the image and a link/QR code to the original unaltered version

For online listings under the broker's control, the unaltered version of any digitally altered image must also be included or linked on the same posting

"Digitally altered image" includes photos modified with editing software or AI to add, remove, or change elements like furniture, fixtures, paint colors, landscaping, views, or neighboring properties

Standard photo adjustments such as lighting, cropping, color correction, exposure, and straightening are exempt from the disclosure requirements

Willful violations constitute a crime under existing Real Estate Law enforcement provisions
