Residential buildings damaged or destroyed in Governor-declared disaster emergencies need only meet the solar photovoltaic requirements that were in effect when the original building was constructed, not current standards

Eligibility requires the building owner's income to be at or below the county median income as determined by the Department of Housing and Community Development

The exemption applies only if the replacement construction does not exceed the original square footage, is built on the same site, and the owner did not have code upgrade insurance at the time of the disaster

The provision expires and is repealed on January 1, 2028

Local agencies will be responsible for determining compliance with older photovoltaic requirements, but no state reimbursement is provided for this mandate
