Expands eligibility for streamlined ministerial housing approval on hazardous waste sites by allowing development if the applicant agrees to obtain site suitability clearance before certificate of occupancy is issued, rather than requiring clearance before project approval

Authorizes local officers meeting Health and Safety Code Section 101480 requirements to independently determine site suitability for residential use or require remediation as a condition of approval

Requires Phase I and, if warranted, Phase II environmental assessments when local officers condition approval on making sites suitable for residential use

Mandates that any identified hazardous substance releases be removed or mitigated to applicable regulatory standards before certificate of occupancy can be issued

Preserves authority of state agencies (Department of Public Health, State Water Resources Control Board, Department of Toxic Substances Control) to override local officer determinations when based on previously considered information
