Amends Labor Code Section 210 to allow employees to recover the $200 penalty for wage violations through an independent civil action, in addition to existing recovery methods through the Labor Commissioner or statutory penalty procedures

Applies specifically to subsequent violations or willful/intentional violations of wage payment requirements, which carry a $200 penalty plus 25% of the amount unlawfully withheld

Initial wage payment violations remain subject to a $100 penalty per employee under existing law

Prohibits employees from recovering both a statutory penalty and a civil penalty under PAGA (Private Attorneys General Act) for the same violation

Introduced by Senator Wiener with coauthors Senator Wahab and Assembly Member Haney; amended in Senate on April 10, 2025 and January 20, 2026
