Prohibits residential care facilities for the elderly (RCFEs) that receive Medi-Cal reimbursement from charging Medi-Cal-enrolled residents a room and board rate exceeding the difference between the resident's income and the personal and incidental needs allowance set for SSI/SSP recipients in nonmedical out-of-home care

Excludes from countable income (for Medi-Cal eligibility purposes) the difference between a resident's income and the rate charged by an RCFE, up to the personal and incidental needs allowance amount

Removes existing provisions that allowed the State Department of Health Care Services and Department of Social Services to waive rent control prohibitions for facilities participating in assisted living waiver programs

Implementation is contingent on obtaining necessary federal approvals and maintaining federal financial participation in Medi-Cal

Creates a new crime for violations, as the California Residential Care Facilities for the Elderly Act makes violations criminal offenses
