Sexual assault survivors aged 18 or older who are undecided about reporting to law enforcement may request that their forensic evidence kit not be tested at the time of examination or afterward

If a survivor requests no testing at the time of examination, the medical facility must not submit the kit to a crime laboratory, and the investigating agency must retain it until testing is requested

If a survivor requests no testing after the examination, the investigating agency must either retain the untested kit or retrieve it from the crime laboratory if testing has not yet begun

Survivors who initially declined testing may later request that their kit be tested, regardless of whether they decide to report to law enforcement

Transfer of a kit from a medical facility to a crime lab solely for secure transport or intake does not constitute submission for testing and must be documented in chain of custody records
