HB 10-1066 Summary

• Department of Education shall procure and distribute approved food and beverages to boards of cooperative services (BOCES) that contract for these services, effective January 1, 2011.

• State Board of Education must promulgate rules by November 1, 2010 identifying approved foods and beverages, which must meet science-based minimum nutritional standards.

• Approved foods cannot contain 35% or more calories from fat, 10% or more from saturated fats, trans fat, more than 35% calories from sugars (except yogurt limited to 30 grams), or more than 200 grams of sodium per portion; fruits, nuts, seeds, and eggs are exempt from these requirements.

• BOCES may contract with the Department, one or more food distributors, or any combination thereof for food and beverage provision.

• Department of Education is exempt from state procurement code requirements when procuring and distributing approved foods and beverages under this bill.
