Prohibits persons (other than parents or legal guardians) from selling, exchanging, giving, or loaning aerosol paint containers, broad-tipped markers, or paint sticks to anyone under 18 years of age without written parental or guardian consent.

Requires retail establishments selling graffiti materials to post two signs: one in clear public view describing graffiti penalties (up to 18 months jail and $5,000 fine), and one visible to checkout staff stating the $1,000 fine for selling these items to minors.

Establishes penalties for violations as an unclassified misdemeanor: up to $250 for first violation, up to $500 for second violation, and up to $1,000 fine plus 60 days jail for third or subsequent violations.

Makes parents or legal guardians of minors jointly and severally liable for all fines, with potential property liens for non-payment; courts may waive fines upon finding of indigence.

Directs 50 percent of collected fines to the juvenile diversion cash fund for implementation of juvenile diversion programs; becomes effective August 11, 2010, subject to referendum petition.
