HB 10-1160 Summary

• Allows health insurance carriers to offer incentives and rewards for participation in wellness and prevention programs for individual and small group health plans in Colorado.

• Enables incentives to be tied either to program participation alone OR to satisfaction of health risk factor standards (such as smoking, diet, exercise), subject to compliance with federal Health Insurance Portability and Accountability Act requirements.

• Establishes that incentives based on health risk factor satisfaction cannot exceed 20 percent of employee-only coverage costs and requires carriers to submit wellness program proposals to nationally recognized accrediting entities for approval before implementation.

• Requires wellness programs to be voluntary with alternative standards or waivers available for individuals with medical conditions, and prohibits carriers from using wellness programs to increase rates for non-participants.

• Effective July 1, 2010, and repealed effective July 1, 2015; requires the Division of Insurance to report wellness program participation data to legislative committees and the public through January 1, 2015.
