Creates a class 6 felony for persons convicted of driving under the influence (DUI) or DUI per se at any time after two or more previous DUI or DUI per se convictions.

Courts must sentence offenders under the new felony provision in accordance with section 18-1.3-401 (1) (a) (V), C.R.S., and must require completion of an alcohol treatment program at the offender's own expense.

Courts must require offenders to attend at least one meeting of an advocacy group for victims and family members of victims of drunken drivers.

Appropriates funds from the Capital Construction Fund to the Corrections Expansion Reserve Fund for fiscal years 2010 through 2014 to accommodate increased incarceration needs.

Effective date is August 11, 2010, unless a referendum petition is filed, in which case the act requires approval by voters at the November 2010 general election.
