HB 10-1286 Summary

• Repeals the Department of Corrections as an independent principal department and transfers it to the Department of Public Safety as a new Division of Corrections through a Type 2 transfer.

• Transfers the Division of Youth Corrections from the Department of Human Services to become a subdivision within the Division of Corrections in the Department of Public Safety.

• Transfers all statutory authority, powers, duties, personnel, property, funding, budgeting, purchasing, and planning of both departments to the Department of Public Safety effective July 1, 2011.

• Updates all existing state laws and rules referring to the Department of Corrections or Division of Youth Corrections to instead refer to their respective divisions and subdivisions within the Department of Public Safety.

• Employees of both transferred departments retain all state personnel system and retirement benefits, and existing contracts and appropriations transfer to the Department of Public Safety with its assumption of all rights and obligations.
