HB 10-1361: Wildlife Commission Fee Simple Title Acquisitions

• Wildlife commission may purchase and retain fee simple title to real property using habitat stamp funds only when no other type of interest is viable or available.

• Commission must report to House Agriculture, Livestock, and Natural Resources Committee and Senate Agriculture and Natural Resources Committee documenting efforts to explore all other acquisition options before acquiring fee simple title.

• Each fee simple title purchase must include a realistic estimate of operation, maintenance, and enhancement costs, with that amount deposited in the newly created Colorado Wildlife Habitat Stamp Operation, Maintenance, and Enhancement Fund.

• Commission must develop rules to evaluate and report biennially on fee simple land holdings and is authorized to sell all or portions of such property when sales allow continued achievement of the property's original acquisition goals.

• Proceeds from sales of fee simple properties shall be handled like habitat stamp revenues, while proceeds from other transactions (leases, etc.) shall be deposited in the operation and maintenance fund.
