House Bill 10-1363 Summary

• Directs the Colorado Public Utilities Commission to give fullest possible consideration to cost-effective implementation of new energy technologies for generating electricity from methane produced biogenically in geologic strata as a result of human intervention when reviewing generation acquisitions for electric utilities.

• Expands the definition of "clean energy" to include methane that has been produced biogenically in geologic strata as a result of human intervention, provided it does not involve additional land disturbance.

• Takes effect 90 days after the general assembly's final adjournment (August 11, 2010, if adjournment occurs on May 12, 2010), subject to referendum petition requirements and voter approval if challenged.

• Section 1 takes effect only if House Bill 10-1001 is enacted and becomes law.

• Applies to conduct occurring on or after the bill's effective date.
