HB10-1371: Colorado Health Freedom Act

• Exempts unlicensed complementary and alternative health care practitioners from state health care licensing requirements if they comply with specified disclosure and conduct restrictions.

• Prohibits unlicensed practitioners from performing surgery, prescribing drugs or controlled substances, administering x-rays, manipulating joints or spine, setting fractures, providing medical disease diagnoses, or recommending discontinuation of licensed medical treatment.

• Requires practitioners to provide written disclosure to clients including their name and qualifications, statement that they are unlicensed, nature of services, and any prior disciplinary actions or felony convictions, with client acknowledgment required before treatment begins.

• Classifies violations of the act as deceptive trade practices under Colorado's Consumer Protection Act, allowing consumers to seek civil remedies for violations.

• Takes effect August 11, 2010, subject to referendum petition procedures under the Colorado Constitution.
