SB 10-011 Summary

• Requires disclosure of physician relationships with insurers, self-insured employers, or claimants before independent medical examinations, with parties entitled to review summaries before striking physicians from examination lists.

• Prohibits insurers, employers, health care providers, and their employees or contractors from paying or receiving financial incentives based on days to maximum medical improvement, claims approval/denial rates, number of procedures approved, or other criteria designed to encourage violations of workers' compensation law.

• Establishes treating physicians must either have injured workers present during employer/insurer communications or maintain accurate written records of communications that are provided to injured workers like medical records.

• Voids any insurance contract provisions establishing reversionary interests in indemnity benefits for insurers as against public policy.

• Designates violations as unfair insurance practices subject to penalties under Colorado law; Section 1 effective July 1, 2010, remaining sections effective upon passage.
