Amends Colorado law to allow the Groundwater Commission to alter boundaries of designated groundwater basins by adding lands based on adequate factual data.

Permits the Commission to exclude lands from a designated groundwater basin only if factual data justifies the alteration AND the alteration would not exclude any well with a conditional or final permit to use designated groundwater.

Establishes that the date a groundwater basin designation becomes final serves as a cut-off date beyond which the legal status of groundwater in that basin cannot be challenged.

Declares that any request to exclude permitted wells from an existing groundwater basin after the cut-off date constitutes an impermissible collateral attack on the original basin designation decision.

Provides that the act does not affect litigation pending under this section as of January 1, 2010, and takes effect 90 days after final adjournment of the general assembly.
