Exempts public school wells from the Water Right Determination and Administration Act of 1969 if they pump 15 gallons per minute or less, are located in a school district serving 25,000 people or fewer, and are used only for irrigation

Requires school districts or public schools to obtain confirmation from the State Engineer that the exemption applies before the exemption takes effect

Applies only to exemption applications filed on or after the effective date of the act

Takes effect at 12:01 a.m. on the day following the 90-day period after final adjournment of the general assembly, unless a referendum petition is filed, in which case approval by voters at the November 2010 general election is required
