Requires public high schools and institute charter high schools using American Indian mascots to either cease use or obtain approval from the Colorado Commission of Indian Affairs by July 1, 2013.

School districts and state charter school institute must notify affected high schools and the commission of American Indian mascot use by January 1, 2011.

Imposes monthly fines of $1,000 per school district or charter school institute for continued use of American Indian mascots after July 1, 2013 without commission approval, with fines credited to the state education fund.

Defines "American Indian mascot" as any name, symbol, or image depicting or referring to an American Indian tribe, individual, custom, or tradition.

Grants the Colorado Commission of Indian Affairs authority to evaluate and approve or deny the use of American Indian mascots by public high schools.
