HB11-1012 Summary

• Allows unaffiliated registered electors to request and vote the primary ballot of a political party without declaring affiliation with that party.

• Requires unaffiliated electors voting in a primary to openly declare either their intent to affiliate with a party or to remain unaffiliated while requesting a specific party's ballot.

• Applies to both in-person voting at polling places and mail-in ballot voting, with election judges or county clerks delivering the appropriate party ballot based on the elector's declaration.

• Modifies electronic voting system requirements, mail ballot procedures, and provisional ballot rules to accommodate unaffiliated electors requesting a specific party's primary ballot.

• Takes effect August 10, 2011, unless subject to a referendum petition, in which case it requires voter approval at the November 2012 general election.
