HB 11-1069 Summary

• School district boards of education must adopt and implement a physical activity policy for elementary students beginning in the 2011-12 school year.

• Elementary students must have access to minimum monthly or daily physical activity: 600 minutes per month for full-day students at five-day schools, 300 minutes per month for half-day students, 30 minutes per day for full-day students at schools meeting fewer than five days per week, or 15 minutes per day for half-day students at schools meeting fewer than five days per week.

• Physical activity includes exercise programs, fitness breaks, recess, field trips with physical activity, classroom activities with physical activity, and physical education classes.

• Schools that provided more than the minimum physical activity prior to January 1, 2011 cannot decrease those amounts except in response to budgetary constraints, and schools cannot substitute noninstructional physical activity for standards-based physical education instruction.

• Charter schools must also adopt and implement compliant physical activity policies, and state school performance reports are encouraged to include information about each school district's and school's incorporation of physical activity into the school day.
