HB 11-1107: Enforcement of Illegal Immigration Violations

• Directs state and local law enforcement to fully comply with and assist in enforcement of federal immigration laws, and requires reasonable attempts to determine immigration status during lawful contact when reasonable suspicion exists that a person is unlawfully present.

• Creates new state crimes including willful failure to carry alien registration documents (Class 1 Misdemeanor), unlawful stopping to hire or pick up passengers for work (Class 1 Misdemeanor), and knowingly applying for or performing work while unlawfully present (Class 1 Misdemeanor).

• Establishes mandatory vehicle impoundment or immobilization for vehicles used to unlawfully transport, conceal, harbor, or shield unlawful aliens, with exceptions for child protective services workers and emergency responders.

• Creates the Immigration Enforcement Mission Fund consisting of civil penalties and court assessments, to be used by the Department of Public Safety to offset immigration enforcement costs and reimburse local governments for county jail costs.

• Allows law enforcement officers to arrest without a warrant any person who has committed a public offense making them removable from the United States, and prohibits state and local agencies from restricting immigration status information sharing with federal entities.
