State Patrol retains sole authority to designate routes for motor vehicles transporting hazardous materials after consultation with local governmental authorities.

Gasoline, diesel fuel, and liquefied petroleum gas are automatically exempt from route designation unless a petitioning authority requests their inclusion.

State Patrol may exempt crude oil from route designation upon request from a petitioning authority, with approval or denial based on factors listed in section 42-20-302(8).

Route designations do not apply to motor vehicles transporting products necessary for agricultural production to or from farm or ranch sites.

Effective date is 90 days after final adjournment of the general assembly (August 10, 2011, if sine die adjournment is May 11, 2011), subject to referendum petition provisions.
