HB 11-1200 Summary

• Amends Colorado law to require substance abuse assessments for individuals convicted of felonies (on or after July 1, 1992) or misdemeanors/petty offenses (on or after July 1, 2008) who are sentenced to probation with department supervision.

• Allows assessments to be conducted as part of probation intake if the presentence report investigation is waived, rather than only during the presentence investigation phase.

• Assessment must evaluate use of controlled substances or alcohol using standards developed under section 16-11.5-102(1)(a) of Colorado Revised Statutes.

• Effective date is August 10, 2011, subject to a referendum petition period; if petitioned, bill requires voter approval at November 2012 general election before taking effect.
