House Bill 11-1239 Summary

• Amends Colorado Revised Statutes 2-2-322 to require fiscal notes include additional information for bills that create new crimes, increase or decrease crime classifications, or change crime elements.

• Fiscal notes must include a description of the elements of proposed new crimes or amended/additional elements of existing crimes.

• Fiscal notes must analyze whether the new crime or changes may be charged under current Colorado law and compare the proposed crime classification to similar offenses.

• Fiscal notes must analyze the current and anticipated future prevalence of the behavior the proposed new crime or criminal changes intend to address.

• Act takes effect August 10, 2011, or if subject to referendum petition, upon voter approval at the November 2012 general election.
