HB 11-1252 Summary

• Secretary of State must periodically cross-check the statewide voter registration database against federal and state agency records to identify registered electors who may not be U.S. citizens.

• Secretary of State sends notice by return receipt to any elector suspected of not being a citizen; the elector has 90 days to provide proof of citizenship (U.S. passport, birth certificate, naturalization documentation, I-9 form, or other federal proof).

• Electors claiming financial hardship can request the Secretary of State obtain their birth certificate at no charge (if born in Colorado) or request it from the appropriate state (if born elsewhere).

• If an elector fails to provide proof of citizenship within 90 days, the county clerk marks the registration record "Incomplete" and the elector cannot vote until the record is completed.

• Electors with "Incomplete" records can restore voting eligibility by providing proof of citizenship within 6 years; the bill appropriates $12,060 to the Department of State and $19,425 to the Department of Public Health and Environment for implementation, effective January 1, 2012.
