HB 11-1256: Crimes Against an Unborn Child

• Creates new Article 3.5 establishing offenses against pregnant women and unborn children, including unlawful termination of pregnancy in the first through fourth degrees with penalties ranging from Class 1 misdemeanor to Class 2 felony

• Excludes from prosecution any consensual medical care, assisted reproduction services, genetic testing, and prohibits prosecution of the pregnant woman herself

• Establishes vehicular unlawful termination of pregnancy (Class 4 felony) and aggravated vehicular unlawful termination (Class 3 felony) for reckless or impaired driving causing termination

• Explicitly states the bill does not confer "person" status on human embryos, fetuses, or unborn children at any stage prior to live birth

• Appropriates funds over 5 fiscal years (2011-2015) from the capital construction fund and general fund for corrections expansion to implement the new offenses, and repeals prior criminal abortion statutes
