House Bill 11-1275 Summary

• Establishes a statewide engine idling standard for commercial diesel vehicles with a gross vehicle weight rating exceeding 14,000 pounds designed for highway operation.

• Prohibits covered vehicles from idling for more than 5 minutes within any 60-minute period, with 20-minute allowance when ambient temperature is below 10 degrees.

• Provides exemptions for traffic delays, emergency vehicles, maintenance operations, defrosting/heating/cooling for safety, power take-off equipment operation, and sleeper berth climate control at designated locations.

• Allows local authorities to adopt idling ordinances consistent with the state standard, except for jurisdictions with average elevation over 6,000 feet that had ordinances in effect on January 1, 2011.

• Establishes penalties of up to $150 for first offense and up to $500 for subsequent offenses as Class B traffic infractions, plus $20 surcharge; effective July 1, 2011.
